A letter addressed to BIR Commissioner Kim Henares is circulating online and has gone viral. The letter, originated from unknown source, made mentioned about Manny Pacquiao's tax case. It also mentioned Lucio Tan and other known persons, pointing these persons as tax evaders but accounts were not garnished.

Dear Kim Henares,

I do not doubt your sincerity to collect taxes from every Filipino, living or dead.

I do not even doubt your integrity in making sure that you are able to collect the proper taxes from everyone.

I am however questioning your motives and arbitrary choice in the personalities you choose to prosecute.

I am going to cite one particular person who has been on the BIR's radar as a perennial tax evader for the last 20-years with cases going in and out of court.

His name is Lucio Tan and he owes the country more than 5-billion pesos in tax liabilities decided on numerous times by the Supreme Court as executory stand final and yet no garnishment order was ever made until his petition in the SC reversed their decisions time and again.

Lucio Tan was never known for his philanthropy or good business practices. He authored the contractualization of PAL and Asia Brewery employees which was not only detrimental to Filipino Labor but also to taxes that could be collected from these workers had they been regular employees.

Lucio Tan is also accused of ill-gotten wealth from his Marcos days, and yet he continues to enjoy his money.

Congressman Manny Pacquiao's case is not even at the High Court and his earnings have already been garnished.

You have been given certified true copies of Pacman's tax payments in the US and yet you refuse to recognize this and insist on originals which I believe, but I may be mistaken, even? US citizens have no access to.

And to think that Pacquiao earned his money through honest, literally blood, sweat and tears. And he is one of about ten persons who insist in keeping his money in the Philippines because he is a patriot.

He could have stashed it somewhere you cannot reach it if he had things to hide, but he kept it here, so our economy can make use of it.

You cannot even freeze the money of politicians involved in the PDAF scam but you can do this to an ordinary man who managed to rise above all of you through hard work, guts, integrity and the work of his own hands.

And that is why your integrity is rapidly being eroded, because you don't seem to think anymore. You just grab the first victim that cannot fight you.

Because even if Pacquiao is a Congressman, he is not connected to the old boys club and so does not have the clout of the Tan's, Sy's, Dy's and others.

Oh, and Lucio Tan did give over 100 million to Noynoy's election kitty while Pacquiao was with the opposition.

I guess we know now the motivations don't we?

Bakit naman kayo nagagalit sa BIR ehh ginagawa lang naman nila trabaho nila....binigyan ng mahigit 2 taon si Manny para ma submit ang mga mga papeles na nagpapatunay na nagbayad nga sila ng tax sa US pero di nila naibigay....so ibig nyo bang sabihin na OK lang na di magbayad ng tamang TAX si Manny?????? opppsss hindi naman yata tama yon....

Kung ginagawa ng BIR ng tama ang trabaho nila,wala sana tayong deficit sa tax collections,bakit kamo,ano ginagawa ng mga BIR Examiner sa distirct level na may hawak ng mga multinational companies,under tax lahat yan para may under-the table sila!!!

    3. FYI, if you won't pay taxes here in US esp that you are living outside, goodluck...uncle Sam will be running after you even if you're dead. I don't think manny can step in US soil without being interrogated the moment he will arrive in the country.   14. The burden of proof is on Pacquiao. If he indeed paid his taxes here or in the US then show it to BIR and the public( his choice). Tapos usapan. Not a mere certification from top rank boxing. Do not be misled with this issue. Papayag kayo na di singilin si pacquiao ng tax while a common man bawas kaagad sa sweldo ? Because he is percieved as our modern hero? I love pacquiao as much as everybody else here but like us he is obligated under the law. If we really want change and reform everybody should follow the law i mean everybody

    1. +1 to you. My guts also tells me such is the case. There must be "win-win" in here naman eh. As much as I love Pacquiao too, I believe may lapses din sya sa pag submit ng document kung totoo nga na 2 years pa yung notice even though Pacquiao said gave BIR the letter from Top Rank and/or copy of receipts. If it's a certified true copy from the IRS, kahit pa may katagalan makuha yon, then do it. Thing is, parang kailan lang pala sila nag request sa IRS.

      As for Pacquiao paying taxes, he made it to top 33 nga last year, so nasingil naman sya ng BIR. I think that also had some weight why he's adamant on the additional documents being requested by BIR.

They cant even find anything wrong on his tax obligations in our country so they evev reviewed his earnings in US. My point? Of all people, why is MP on the priority list? Does it mean that all OFWs are also going to pay taxes when they come home after their contracts overseas are done?   30. The reason why the Philippines is not progressing the way that it should be progressing is not because of the people who are sitting in the position but because of the people who made them sit on their position.

    Its amazing how MOST FILIPINOS KEEP blaming the politicians while they are the ones who elected them in the first place and second, wala rin naman silang ginagawang matino as a Filipino citizen yet they are the ones to COMPLAIN FIRST.

    In my opinion, I'd rather post SOLUTIONS than USELESS CRITICISMS such as this kind of letter. Collecting tax is just part of the job of Kim Henares, you cannot blame her for doing her job.


    Its true that Kim Henares may have loop holes, but EVERYONE HAS A LOOPHOLE. People will find loopholes if they really wantr to see this. NOBODY IS PERFECT. Remember that!

    So as a concerned citizen, I'd rather see the good things and praise AND see the bad things but offer SOLUTIONS instead of USELESS criticisms.

Sana bago mamatay ang tao sa katandaan, sakit , o aksidente ma isip nila ang ika bubuti nang lahat, kung sino ang nag sulat nito may point din, dapat tingnan nang BIR, dito sa amin ang daming reklamo against BIR kasi may mga corrupt din sa kanila....Maam Henares prove to us that you are sincere of your duty, ang ating pambansang kamao dapit niyang sagutin o harapin ang BIR, at dapat yong mayayaman na alam ang kalakaran sa goberno natin dapat managot na silang lahat nang nandaraya, nanloko at nagnakaw sa bansa at sa mga pilipino panahon na kung hindi ngayo kailan pa kung patay na kayong na sa mga position....

  71. Hindi pala pulubi ibig kung sabihin ay mahirap, nakaka awa, ginagawa lang iba ang mga ibang OFW natin na katulong sa ibang bansa at inaabuso pa. Dito sa atin bihira lang na makakita ka nang foreigner naging domestic helper....

  73. This is purely political. Even though Manny may have missed to pay the right taxes just like other million Filipinos, there are many win win solutions to settle issues like this one. Manny is just one man and he has paid too much not considering the intangibles that he has given this country like pride and hope. The government should make considerations.

  75. Why cant we just let people from the govt do their respective jobs since most of them seems to be new to their present positions. And just so you all know, all these problems facing by the current govt was just inherited by the previous govt. Nobodys to be blamed nor be praised. This is an outcome of a chain reaction that nobody has the power to turn back the time. What we can do is help this country by thinking on how we can make a difference that starts from ourselves. DO NOT DO TO OTHERS WHAT YOU DONT WANT OTHERS DO TO YOU: if each and every one of us think this way then that will make a good start...what do you think?

Sa amin nga sa Bohol, may intsik na Negosyante, who owned gasoline station, may barkong bumibyahe daily scheduled to Cebu, may mga tindahan pa, yung business owner sabay silang nagbayad ng tax nang nanay ko,yung nanay ko na titser nag bayad 7K pero yung intsik nag bayad lang ng 3K +, tinanong nang Nanay ko yung BIR officer bakit gannon lang ang binayran nong intsik, kaya inaway ng Nanay ko yung Taga BIR sa awa ng dyos, tinawanan lang yung nanay ko nong taga BIR.

  80. I wish I was the BIR so I can make the most of the taxes smaller for the poor people who are receiving an income not exceeding Php 60,000. Just a comment guys hehehehehe :) Kung totohanin ito, EDI WOW!!!!!!!
